Guardianships & Special Needs Trusts

I need help setting up a guardianship for a disabled or incapacitated loved one.

We can assist you as petitioner in obtaining court appointment of a guardian of a person that appears to need assistance with his or her property or personal issues.  We can also represent a person alleged to be incapacitated as well as other interested parties.

My loved one is disabled or a minor, and I need help setting up a special needs trust or settlement trust.
  • Estate Planning.  We can provide you advice related to estates for loved ones who need medical assistance through the government, usually through Medicaid.  Typically our assistance will involve a special needs trust to allow for continued medical assistance but provide a "safety net" of funds for the person with a disability.

  • Court-Supervised Special Needs Trusts.  We can assist you with the development, formation and ongoing administration of a special needs trust to hold funds from a settlement or probate to allow continued Medicaid assistance or supervision of funds for a disabled beneficiary.  We provide advice to plaintiff's counsel, family members or a proposed trustee with this special type of trust, as well as ongoing assistance once the trust is created.
