ESTATE PLANNING CHECKLIST


1. Do you have a Will or Living Trust?

  • Does it meet your family's needs?

2. Is your estate, including retirement benefits and proceeds of life insurance, over $1,000,000? If so,

  • Have you executed Trust Wills to reduce estate tax?
  • Have you started a tax-saving program of gifts to family members?
  • Have you thought about charitable gifts?
  • Have you considered life insureance to help fund the estate tax liability?
  • Does a family limited liability company make sense for you?
3. Do you have an interest in a family business? If so,
  • Do you have a strategy for reducing the estate tax cost for passing it on?
  • Can you defer the estate tax attributable to the business?
  • Have steps been taken to ensure a smooth transition of control?

4. Do your life insurance and retirement plan beneficiary designations, your joint tenancy assets and any community property agreements conform to your overall estate plan?

 

5. Do you have a Durable Power of Attorney to provide for continued management of your financial affairs and health care decisions in the event of your disability?

 

6. How do you feel about (a) artificial life support; (b) organ donation; (c) how your remains should be handled? If you have specific wishes, have you documented them in writing?
