Pemco retained Brad Maxa to defend a teenager accused of causing a horrendous accident while riding his bicycle down a country road. The plaintiff was riding a motorcycle in the same direction as the bicycle, and his lawyer claimed the teenager drifted or swerved into the motorcycle’s path and caused a collision. The plaintiff suffered massive head injuries, leaving him with a sever brain injury and unable to work for the rest of his life.

The problem: Neither party remembered the accident (the teenager also suffered a significant head injury) and no witness saw the actual impact. The plaintiff’s expert claimed that the mechanics of the accident and physical evidence at the scene proved that the bicycle was at fault. Brad carefully pieced together testimony from witnesses who saw the motorcycle and bicycle moments before, and seconds after the impact and developed his own expert testimony to discredit the plaintiff’s theory. After a hard fought trial against a top-notch plaintiff’s attorney, the jury returned a defense verdict.
