Cochran and Amala Negotiate $750,000 Settlement in Multi-plaintiff Toxic Tort Case
As recently reported on the front page of the Tacoma News Tribune, Darrell Cochran and Jason Amala have negotiated a $750,000 settlement on behalf of 25 plaintiffs in a toxic tort case that involved a mold infestation at the Eagles Watch apartment complex in Puyallup, Washington ("A moldy, costly mess"). Cochran asserted that the owner of Eagles Watch, the Pierce County Housing Authority, had known of the mold problems since it purchased the complex the early 1990s but chose to ignore those problems despite years of complaints by tenants that the mold was out of control and was causing them health problems. Aside from a victory for his clients, Cochran noted that the case and the resulting settlement should serve as a reminder to landlords that "it is precisely because Washington has a wet climate that landlords have a very real legal obligation to work with their tenants to pro-actively resolve mold and moisture issues before they get out of hand."
