GTH Partner Michelle Menely obtained a successful result in an insurance coverage matter. Insured was sued by siblings for engaging in intentional conduct and for allegedly defaming the siblings. The policy provided coverage for defamation, provided the defamation was not done knowingly; the complaint alleged knowing conduct.

A declaratory judgment action was brought on the grounds that if the plaintiffs proved their case, that such proof would negate coverage under the policy. Michelle successfully moved for summary judgment, resulting in judicial declaration that insurer did not have a duty to defend, or indemnify, for the claims being made against insured.
