Partner Michelle Menely successfully defended clients in a negligent storage of a firearm case. Plaintiff suffered a gunshot injury in homeowners/clients’ home at the hands of clients’ adult son. The incident occurred while the parents were on vacation and the son was house-sitting. The gun used by the son was a gun that the homeowners left loaded and within easy access to son, who had a history of non-violent criminal activities. The son pled guilty to first-degree assault of the plaintiff. Plaintiff brought action against homeowners/parents on the theory of negligent storage of a firearm, asserting that the negligent storage – and not the acts of the son -- was the proximate cause of his injury. Plaintiff was seeking in excess of $1 million in damages.
